On 2 September, Kyiv hosted the X INTERNATIONAL BUSINESS PROTECTION FORUM organised by the Yurydychna Praktyka publishing house. The first session of the event was devoted to the main trends in business protection under martial law and brought together representatives of the legislative, executive and judicial branches, the bar and the business sector.
Taras Ivanenko, Partner and Head of Anti-Corruption Practice at EVERLEGAL, Attorney, PhD in Law, focused in his speech on the key challenges that businesses face in their interactions with law enforcement agencies.

Taras highlighted several key pain points for businesses:
- Violation of the principle of jurisdiction — different law enforcement agencies may investigate the same offences, which creates risks of duplication and pressure on businesses.
- Incompatibility of criminal actions and the actual situation — often, investigative actions and arrests are carried out without proper justification, and the results of the investigation do not correspond to the essence of the criminal proceedings.
- Procedural vacuum regarding arrests and temporary access to property and documents — seized property often does not have the legal status of arrested property, which makes it impossible to return it and creates risks for businesses. Temporary access to documents and assets may be indefinite, further restricting the rights of businesses.
- The lack of control over the duration of pre-trial investigations — delays in proceedings lead to prolonged pressure on businesses and restrictions on their property rights.
