On 13 May, the III WHITE-COLLAR CRIME FORUM took place in Kyiv, organised by the Yurydychna Praktyka.
Taras Ivanenko, Partner and Head of Anti-Corruption Practice at EVERLEGAL, Attorney, PhD in Law, spoke at the second session dedicated to the discussion of Procedural Aspects of WCC Proceedings.
Topic of the speech: 'Crime after the result: risks of assessing the legality of actions based on consequences rather than circumstances'.
‘Defence in criminal proceedings is a rather long and exhausting marathon, but only a consistent and coordinated position of the defence, a properly formulated strategy and its implementation can ensure a positive result,’ said Taras
In his speech, the Taras drew attention to the rather widespread practice of assessing the actions of the accused not at the time of their commission, but after the consequences have occurred - this is worrying because legal assessment should be based not on the result, but on the intention, knowledge and circumstances that existed at the time of the act.
Taras Ivanenko explained why retrospective sentencing contradicts the basic principles of criminal procedure and the rule of law. In his opinion, it is at least dangerous to punish for the result and not for the intention.
