Administrative Services in the Construction Sector During the Martial Law
On 24 February 2022, the provision of administrative services in the construction sector via the Unified State Electronic System in the Construction Sector ("USESCS") and Administrative Service Centres ("ASC") was suspended.
On 17 March 2022, Minregion announced that the USESCS resumed its work, and on 22 March 2022, the ASCs also resumed their work, in particular, to provide administrative services in the construction sector.
Relevant services will be provided regarding the construction sites in Cherkasy, Chernivtsi, Dnipropetrovsk, Ivano-Frankivsk, Khmelnytskyi, Kirovohrad, Lviv, Odesa, Poltava, Rivne, Ternopil, Vinnytsia, Volyn, Zakarpattia and Zhytomyr regions.
What administrative services can be obtained via the USESCS and ASC?
It is possible to obtain all administrative services in the construction sector provided before the war, including:
Via USESCS:
- downloading design documentation for the construction of facilities;
- examination of construction facilities;
- issuance of urban planning conditions and restrictions;
- obtaining a construction passport for land development;
- obtaining the right to perform preparatory and construction works (regarding facilities with CC1, CC2 and CC3 class of consequences);
- commissioning of construction facilities (regarding facilities with CC1, CC2 and CC3 class of consequences); and
- assignment, change, adjustment, cancellation of the address of the construction facility (regarding facilities with CC1, CC2 and CC3 class of consequences); etc.
Via ASC:
- obtaining a construction passport for land development;
- issuance of urban planning conditions and restrictions;
- obtaining the right to perform preparatory and construction works (regarding facilities with CC1 class of consequences);
- commissioning of construction facilities (regarding facilities with CC1 class of consequences); and
- assignment, change, adjustment, cancellation of the address of the construction facility (regarding facilities with CC1 class of consequences); etc.
What are the terms of providing administrative services in the construction sector?
According to the announcement of the State Inspection for Architecture and Urban Planning of Ukraine, consideration of the submitted documents will be in accordance with the peculiarities of martial law. In practice, this means that the terms of providing construction services may be longer than specified by the Ukrainian legislation.
