EVERLEGAL secured another victory for the client before the Supreme Court

EVERLEGAL team Secured another victory for the client before the Supreme Court in a case brought by the prosecutor seeking termination of a Land Lease Agreement for a plot located in the suburbs of Kyiv.

Case Summary:
At the end of 2023, the prosecutor filed a claim against our client, who leases a municipally owned land plot in the Kyiv suburbs for development purposes. The prosecutor’s position was based on alleged violations of the lease agreement concerning construction deadlines.

EVERLEGAL’s lawyers successfully convinced the court of first instance that, at the time the claim was filed, there was no breach of the lease by the client. This was due to the fact that the parties had signed an updated version of the lease agreement, agreeing on new construction deadlines. As a result, the first instance court dismissed the claim. However, the appellate court reversed this decision.

The final word in the dispute came from the Supreme Court, which overturned the clearly unsubstantiated ruling of the appellate court and upheld the decision of the court of first instance. The Supreme Court agreed with EVERLEGAL’s position that, for the purpose of assessing compliance with construction deadlines, the version of the lease agreement in force at the time of the court’s review should be taken into account.
