EVERLEGAL's Associate spoke at the ECOPROMFORUM dedicated to topical issues of waste management reform 


Lesia Baginska, Associate, Attorney at Law at EVERLEGAL, took part in the Conference on Waste Management and Waste and Recycling Market Legislation and spoke on the topic: “Algorithm of actions for waste generators and processors: what should be done according to the Law of Ukraine “On Waste Management” in order not to be fined and avoid reputational risks”.

The waste management reform introduces many new rules for businesses. For example, business entities that carry out at least some waste treatment operations in accordance with their technological cycle, which includes almost all medical, mining, cardboard and paper, metallurgical industries, plastic processing companies, oil and oil refining, waste sorting (sorting stations), incineration, composting, biogas production or biological treatment, etc. must obtain a waste treatment permit. 

Lesia's presentation took place during the II session of the event, which was aimed at environmentalists from industrial enterprises. Her speech contained detailed algorithms for waste generators and processors to obtain a waste treatment permit in accordance with the requirements of the Law of Ukraine “On Waste Management”. She emphasized the key aspects necessary to avoid fines and reputational risks.

Particular attention was paid to the fact that: 

 

  • Given the martial law, the Government gave businesses time to adapt to the new working conditions under the reform and extended the validity of previously submitted declarations until October 9, 2024. Companies that have submitted declarations may operate under them for another four months, but during this time they must collect all documents and obtain a permit. Companies that have not submitted declarations and want to conduct relevant activities must obtain a permit for waste treatment operations before starting such activities;
  • the list of operations included in the concept of waste treatment and the need for business entities to obtain the relevant permit;
  • the procedure for obtaining a permit for waste treatment; 
  • responsibilities of waste generators and other business entities in the field of waste management;
  • grounds for refusal and revocation of the permit, etc.

Lesia Baginska, Associate, Attorney at Law at EVERLEGAL, expert of the PAEW Environmental Law Committee, provided the conference participants with comprehensive recommendations and explanations on how to comply with legal requirements in the field of waste management.
