Agricultural land for the population: a relatively new and interesting type of investment, purchase and sale
On 1 January 2024, Ukraine officially launched the second stage of land reform, initiated by the adoption of Law No. 552-IX ‘On Amendments to Certain Legislative Acts of Ukraine Regarding the Conditions for the Circulation of Agricultural Land.’ One of the key updates is an increase in the limit on the maximum area of agricultural land that one person can own, from 100 to 10,000 hectares.
In a comment for Finance.ua, Svitlana Teteria, Counsel at EVERLEGAL, explained the key provisions of the legislative changes:
"For Ukrainian citizens, when calculating compliance with the limit, not only land plots directly registered in their name are taken into account, but also those they own indirectly through shares or a stake in the authorised capital of a legal entity that has registered ownership of such plots.
Citizens also have improved access to bank loans secured by agricultural land plots. This is because banks were allowed to acquire ownership of such plots by way of foreclosure as collateral, with a subsequent obligation to dispose of them at land auctions within two years," said Svitlana.
