The IV Conference ‘Compensation for Damage Caused by Aggression: Law & War — 2025’, organised organised by the Yurydychna Praktyka, took place in Kyiv.

Yuliia Tantsiiura, Counsel, expert on compensation for damage caused by armed aggression by the russian federation, EVERLEGAL, spoke about the development of the alter ego concept in judicial practice regarding compensation for damage caused by aggression by the russian federation. Yuliia explained that the alter ego doctrine helps to determine whether a particular entity should be considered an organ or instrument of the state, or in other words, as part of the state or as something that is identified with the state, and whether the court has the right to disregard the formal separation of the property of this legal entity from the property of the state in order to determine the extent of liability.

‘The alter ego doctrine does not require proof that a specific entity, a specific legal entity, participated in any way in the tort,’ Yuliia emphasised.

Yuliia also noted that the doctrine is based on the criteria for recognising alter ego:

  • the legal status of the company (under public or private law);
  • the nature of its activities (public function or ordinary commercial enterprise);
  • the context of its operation (e.g., monopoly or strictly regulated business);
  • its institutional independence (degree of state ownership);
  • its operational independence (degree of state supervision and control).
