EVERLEGAL represented State Joint Stock Holding Company “ARTEM” (leading Ukrainian state enterprise of the engineering and supply of special purposes and military equipment). 

The case is related to the opposition to the execution in Ukraine of four arbitration awards rendered in favor of Avia Fed Service LLC after the termination of cooperation of the defense sector between Ukraine and Russia.
The arbitration process was successfully completed in favour of Avia Fed Service LLC.
In the process of recognising arbitral awards, Ukrainian courts rendered opposite rulings upholding or rejecting the principles of public policy. In 2020, the Supreme Court issued three final decisions refusing to enforce arbitral awards in favour of sanctions, and these three decisions became the power to resolve similar cases with the participation of other parties. Arguing the case, the Supreme Court was called upon to assess the arguments presented in similar situations in the United States, Switzerland, and the United Kingdom, in particular, how the sanctions regime in these countries is similar and different from the Ukrainian sanctions’ regime.
