EVERLEGAL secures recovery of over UAH 10 million in favour of a green energy producer
The EVERLEGAL team successfully resolved a court dispute between a renewable energy producer and the State Enterprise “Guaranteed Buyer”, securing the full recovery of outstanding debt exceeding UAH 10 million, including 3% annual interest and inflation losses.
Background of the Case
A green energy producer approached EVERLEGAL after facing substantial outstanding receivables owed by the State Enterprise “Guaranteed Buyer”. The objective was clear – to recover the debt in full through court proceedings in an efficient manner.
Team Strategy and Actions
EVERLEGAL’s lawyers developed the legal strategy and prepared a detailed calculation of the indebtedness, enabling the claimed amounts to be substantiated beyond dispute. The client’s position was successfully defended before the court of first instance and subsequently upheld on appeal.
During the proceedings, the State Enterprise “Guaranteed Buyer” made partial payments, allowing the team to promptly adjust the amount of the claims and additionally initiate the reimbursement of overpaid court fees.
Result
The courts supported the client’s position at every stage of the proceedings. The debt was recovered in full, and the court decisions were successfully enforced. The entire process – from filing the claim to the actual enforcement of the judgments – took just over one year, which represents a notably efficient result given the workload of the Ukrainian court system and the complexity of similar disputes.
Why This Matters
For companies operating in the renewable energy sector, financial stability directly depends on timely settlements with the State Enterprise “Guaranteed Buyer”. This case demonstrates that a successful outcome is not limited to obtaining a favourable judgment, but also includes the actual recovery of funds by the client. A comprehensive approach – from building a strong legal position to supporting enforcement proceedings – remains essential for the effective protection of business interests.
The matter was handled by Counsel Oleksandr Demchuk, Senior Associate Anna Dvornikova, and Junior Associate Alla Lysak.
