Lesia Baginska, EVERLEGAL lawyer, delivered a presentation at the Second Land Forum in Lviv
The Second Land Forum, organised by the Lviv City Council, was recently held in Lviv.
The aim of the event was to create a platform for dialogue between communities, government officials, judges and lawyers in order to strengthen communities' capacity to resolve land issues and to highlight the importance of land policy in the context of war and reconstruction.
During the forum, special attention was paid to the timely detection of and response to violations in the field of subsoil use and land use. Real cases, legal conflicts and practical ways to overcome them were discussed.
Lesia Baginska, a lawyer at EVERLEGAL, was invited by the Lviv City Council to give a presentation entitled ‘Mechanisms for responding to violations in the field of subsoil and water use: from law to practice’ as part of a panel discussion on ‘Water and subsoil as potential for community development.’
The presentation covers:
- major violations in the field of subsoil and water use;
- problematic aspects of legal regulation of establishing land easements for subsoil users;
- competences of local self-government bodies with an emphasis on delegated powers;
- mechanisms for identifying and responding to violations of the law, bringing perpetrators to justice, taking into account current judicial practice;
- legal instruments for public participation in decision-making processes and public control in the field of subsoil use.
Thanks to open dialogue between representatives of government bodies, lawyers, judges and communities, practical solutions were developed that will help communities to protect their interests more effectively, respond to violations and manage natural resources.
