Yuliia Tantsiiura, Counsel at EVERLEGAL, spoke at the XII LEGAL BANKING FORUM
On 17 February, the XII LEGAL BANKING FORUM took place in Kyiv, organised by the publishing house Legal Practice (Yurydychna Praktyka) jointly with the Ukrainian Corporate Counsels Association.
The second session of the forum focused on compliance, financial monitoring and risk management.
Yuliia Tantsiura, Counsel at EVERLEGAL and an expert in compensation for damage caused by the armed aggression of the russian federation, analysed recent legislative amendments and judicial practice concerning the limits and grounds for the disclosure of banking secrecy. Particular attention was given to the transformation of approaches in the context of Ukraine’s European integration process and the harmonisation of Ukrainian legislation with EU law.
As Yuliia noted, banking secrecy has traditionally been disclosed only in exceptional circumstances – on the basis of a court decision or a duly substantiated request from law enforcement authorities. At the same time, Ukraine’s European integration commitments are shaping a different approach:
“These processes indicate that banking secrecy will be disclosed more frequently and on broader grounds. This is because European integration is aimed at ensuring transparency of financial transactions and tax reporting. These changes are already taking place.”
In conclusion, Yuliia emphasised that a sound banking system is a cornerstone of the state’s financial stability, and that Ukrainian banks have demonstrated a high level of resilience during the full-scale war.
