EVERLEGAL successfully defended the interests of a foreign client and secured the return of seized property to its owner

Case Summary
In 2023, during the customs clearance of a shipment, law enforcement officers conducted a search of vehicles transporting products of one of the world’s leading digital equipment manufacturers. As a result, goods worth approximately EUR 450,000 were seized and placed under arrest.

Due to premature and inadequately justified actions by law enforcement, the Client’s lawful business activities were unlawfully restricted. In response, the EVERLEGAL team prepared and submitted complaints to the Office of the Prosecutor General, the Security Service of Ukraine (SSU), and the National Security and Defense Council of Ukraine. Additionally, a motion to lift the seizure of the property was filed with the court.

Thanks to the professional and comprehensive actions of the EVERLEGAL team, the regional office of the SSU issued a resolution to close the criminal proceedings. Consequently, the court ordered the return of the seized property to its rightful owner.

In addition, the EVERLEGAL team supported the customs clearance process to ensure the final return of the goods to the Client.

Why Is This Important?
The lawyer’s well-reasoned position that the investigative authority had failed to establish any facts that would justify the seizure of property — along with compelling counter-evidence disproving the grounds for such action — enabled EVERLEGAL to protect the Client from unjustified procedural restrictions and secure the return of the property in dealings with the SSU.

EVERLEGAL achieved compliance with the rule of law in this complex case, ensuring not only the protection of the Client’s interests in interactions with law enforcement but also supporting the full restoration of the Client’s restricted rights by overseeing the return of the property until it was physically received by the owner.

EVERLEGAL team on the case includes managing partner Yevheniy Deyneko, senior associates Maryna Fomenko and Iryna Plukar.
