Yesterday, the VIII International Criminal Law Forum took place in Kyiv, organised by Legal Practice (Yurydychna Praktyka). The first session of the forum focused on issues of criminal law and judicial practice in the context of wartime.
Taras Ivanenko, Partner and Head of Anti-Corruption Practice at EVERLEGAL, Attorney-at-Law, PhD in Law, focused in his speech on the asymmetrical approach in the application of law.
Taras Ivanenko drew attention to the practical implications of changes in judicial approaches to the application of procedural time limits in criminal proceedings.
Commenting on the practice of temporary access to items and documents, he noted:
“My personal position is that the time limit established by a court ruling on temporary access to items and documents is a time limit not only for the pronouncement of the ruling, but also for its full execution,” said Taras Ivanenko.
The EVERLEGAL Partner also referred to a high-profile case in which an acquittal was delivered, including on the basis of the current practice of the Supreme Court; however, the case is now under appeal, and the Supreme Court’s practice has since changed, despite the procedural law remaining unchanged.
“My subjective view on resolving this issue is that judicial practice should not be applied retrospectively. Instead, new practice should be applied strictly in accordance with the principle governing the application of procedural law,” emphasised Taras Ivanenko.
