EVERLEGAL advised French company operating in the field of water treatment and waste management, concerning joint projects (within the framework of public-private partnership) with Kyiv and Lviv's municipalities, aimed at the development and construction of facilities for water treatment and waste management.
We are assisting the client with negotiating cooperation arrangement with the municipality to construct and operate waste treatment facility in the City of Lviv and advising the client on proper transactional documentation and regulatory environment as well as on various PPP and public procurement options to be pursued in cooperation with the municipality and municipal companies.
In addition to waste treatment, the project contemplates expansion into water management sector as well as geographical expansion to Kyiv and, possibly, other regions of Ukraine We are also assisting the client with determining an optimal option for cooperation with the municipality, be that under PPP or public procurement framework, or the mix.
This will be one of a few examples of public private partnership in Ukraine in the waste treatment and water management sector. The uniqueness of the project is that if it is a success, it could be scaled across entire Ukraine.
Legal support of this project is a large-scale step towards achieving the UN Sustainable Development Goals, namely:
- Goal 6. Ensure access to water and sanitation for all
- Goal 11. Make cities inclusive, safe, resilient and sustainable
